1. Introduction
PK Spot is legally owned and operated by Lukas Bühler ("PK Spot," "we," "us," or "our"), including its website, applications, and related services (collectively, the "Service"). These Terms of Service ("Terms") govern your access to and use of the Service. By accessing or using the Service, you agree to be bound by these Terms and acknowledge our Privacy Policy.

3. Acceptance of Terms
By creating an account, clicking "Agree and continue," or otherwise accessing or using the Website, you confirm your acceptance of these Terms and agree to be a party to this binding contract.
4. Eligibility
You may use PK Spot only if you are at least 13 years old and old enough to consent to online services under the laws that apply to you. If you are not, your parent or legal guardian must review and agree to these Terms for you.
5. User Accounts and Community Guidelines
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Your use of the Website must be lawful and align with the following guidelines.
A. User Responsibilities: You agree to use the Website in a lawful manner and not to post content that is illegal, offensive, or infringes on the rights of others.
B. Community Guidelines (Code of Conduct): We are a community built on the parkour spirit of respect, mutual support, and creative expression. By using PK Spot, you agree to:
- Be Respectful: We do not tolerate harassment, bullying, intimidation, or hateful conduct. You may not post content that promotes or condones violence, discrimination, or hatred based on race, ethnicity, national origin, religion, gender, sexual orientation, age, disability, or any other protected characteristic.
- Post Constructively: You agree not to post spam, deceptive content, or misinformation. Do not engage in trolling or post content intended to provoke or derail a conversation.
- Protect Privacy: Do not post other people's private or personally identifiable information without their explicit permission.
A breach of these Community Guidelines is considered a breach of these Terms and may result in content removal, account suspension, or permanent termination, as stated in Section 10.
C. Event Promotions and Promoted Events: Events may appear in relevant map areas, community pages, or event lists based on their location, timing, and promotion region. When an event is marked as "Promoted Event," it means PK Spot has a paid or otherwise material promotional relationship with the event organizer. Events that appear only because they are geographically or temporally relevant are not promoted unless they are clearly marked as such.
6. User-Generated Content and License Grant
You retain ownership of the content you create and post, including spots, images, and comments ("User Content"). However, to operate and protect the PK Spot service, you must grant us certain rights.
A. License Grant to PK Spot: By submitting, posting, or displaying User Content on the Website, you grant PK Spot a perpetual, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, create derivative works (such as making your content work better with our service), display, and distribute your User Content. This license allows us to operate the Website and does not grant us the right to sell your individual photos or data to third parties.
B. Your Representations and Warranties: You represent and warrant that you own your User Content or have obtained all necessary rights, licenses, and permissions to grant us the rights described in these Terms. You are solely responsible for your User Content and the consequences of posting it.
C. Media Safety Processing: Images and videos you upload may be checked by automated safety systems and trusted service providers before or after publication. We may block, remove, restrict, or review media that appears to violate these Terms, community safety rules, or applicable law. If uploaded media appears to involve serious illegal content or child safety risks, we may preserve relevant records, restrict access, suspend the account involved, and handle the matter according to applicable legal obligations and our incident process.
7. Community Data & Public License
In the spirit of open data, PK Spot makes its collection of spot data (names, coordinates, descriptions) available to the public under the Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International (CC BY-NC-SA 4.0) License.
Based on the rights granted to us by our users in Section 6, we may also make contributed media (images, videos) available under this same license in the future. This model ensures the data is shared openly while being protected from use in other commercial projects.
8. Copyright & Takedown Policy
PK Spot respects the intellectual property rights of others and expects its users to do the same. If you believe that your copyrighted work has been - copied in a way that constitutes copyright infringement and is accessible on this Website, please notify us. Your notice must include:
- Your physical or electronic signature.
- Identification of the copyrighted work you believe to have been infringed.
- Identification of the material on our services that you claim is infringing, with enough detail for us to locate it.
- Your contact information, including address, telephone number, and email.
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
Please send all infringement notices to the contact email provided on our Impressum page. We will respond to all valid notices and remove infringing content in accordance with applicable law.
9. Assumption of Risk and Responsibility
You understand and acknowledge that physical activities like Parkour and Freerunning involve inherent risks. The level of risk is dependent on many factors, including your own skill, training, judgment, and the physical environment.
- Personal Safety: By choosing to practice at a location found through the Service, you acknowledge the inherent risks of the activity. You are responsible for assessing your own abilities, the condition and safety of any location or obstacle, and whether you need instruction, supervision, protective equipment, or permission. Nothing in these Terms excludes or restricts any responsibility that we have to you under applicable law.
- Legal and Property Respect: Spots listed on this Website are user-generated. We do not verify the legal status or property rights of any location. It is your full responsibility to determine if a location is public or private, to obtain permission where required, and to comply with all local laws, regulations, and signage. You are responsible for legal consequences caused by your own actions, including trespassing.
10. Reports, Complaints, Moderation Decisions, and Appeals
You may use our private contact form to report content or conduct, make a complaint about the Service, or ask us to review an eligible decision. Knowingly false, malicious, repetitive, or automated submissions may be rate-limited or closed, but we will not penalise a person merely because a good-faith report is not upheld.
We may preserve relevant evidence and temporarily or permanently restrict content, a public profile, or participation while investigating or deciding a case. We aim to resolve ordinary cases within 7 days, appeals within 14 days, and complex cases within 30 days, but these are service targets rather than guaranteed deadlines. We provide reasons for consequential decisions. Eligible decisions may be appealed within the period shown in the case record. Appeals should be reviewed by a different reviewer where reasonably possible; if that is not possible, we record the limitation.
11. Termination of Use
We may suspend or terminate your access to the Website at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Website will immediately cease.
12. Intellectual Property
Excluding User Content, all materials on this Website, including text, graphics, logos, and software, are owned by or licensed to the operator and are protected by intellectual property laws. For information regarding the website's underlying source code, see Section 15.
13. Disclaimers and Limitation of Liability
The Service is provided on an "as is" and "as available" basis. We do not promise that every user-submitted location or item of content is accurate, complete, safe, legal, or continuously available.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Nothing in these Terms affects the mandatory rights or remedies available to consumers, including under UK consumer law. Subject to those protections, we are not responsible for loss or damage that is not a foreseeable result of our breach of these Terms or failure to use reasonable care and skill.
14. Modifications to Terms
We may modify these Terms when reasonably necessary, for example to reflect changes to the Service, law, security, or our business. We will post the updated Terms on this page, update the "Last Updated" date, and give reasonable advance notice of material changes where practicable. We will request renewed agreement where required by law. Changes will not retroactively reduce rights you have already acquired. If you do not agree to an updated version, you may stop using the Service and close your account.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. If you are a consumer, this choice does not deprive you of mandatory protections under the law of the country where you live. Consumers may bring proceedings in any court available under applicable consumer law. In particular, consumers living in England and Wales, Scotland, or Northern Ireland may bring proceedings in the courts of the part of the United Kingdom where they live. For users acting in the course of a business, the courts located in the canton of Schwyz, Switzerland, have exclusive jurisdiction.

We believe in transparency and community collaboration. The source code for this Website is open-source and available on GitHub. The code is licensed under the MIT License.
